In re BONHAM RECOVERY ACTIONS, a proceeding to jointly administer certain pre-trial issues in numerous related adversary proceedings.

A Memorandum Decision Granting Motion to Withdraw Proofs of Claim is being filed concurrently. Therefore,

IT IS ORDERED that,

1. MOTION (WHERE FILED) GRANTED TO WITHDRAW PROOFS OF CLAIM FOR CLAIMS WHICH HAVE BEEN FILED-

1.1. For Those Who Have Filed Both Proofs of Claim and Motions or Joinders to Withdraw Them- The motions or joinders in a motion to withdraw the proofs of claim listed in the attached table are GRANTED and the claims shall be withdrawn, subject to śś 3 and 4 of this order.
1.2. For Those Who Have Not Filed Motions or Joinders to Withdraw Their Proofs of Claim- The court has not been able to locate a motion or joinder to withdraw a proof of claim for some claimants. Their name nonetheless appeared on various other motions or tables which indicate they thought they had (e.g., they may have appeared in conjunction with the related motion to withdraw the reference of the BRA adversaries from the bankruptcy court to the United States District Court). These claimants, whose names have been shaded in the second column from the left in the attached table, are:

It may be a court error that it is unable to locate these withdrawal of claim motions, or the claimants' error in failing to file a motion or joinder. In either case, the court offers the following easy way around the problem. The parties listed in this ś 1.2 may file a simple pleading labeled "Joinder in Motion to Withdraw Proof of Claim" stating the wish to do so, and giving the party's name, address, and the proof of claim numbers. A copy should be served on the trustee's counsel, Bundy & Christianson. The time limit for doing this is Friday, January 15, 1999. Failure to have moved to withdraw the proof of claim might be grounds for the district court denying the related motion to withdraw the reference. There is no filing fee to file the motion to withdraw the proof of claim.

1.3. Failure to File Proof of Claim - In some instances, the court has been unable to locate the proof of claim. These are identified in the left hand column of the attached table and have been marked with a shaded "No Claim." The last day to file a proof of claim for prepetition claims has passed. Note, there are special rules for filing claims after the bar date in some situations, but those probably do not apply to the type of claims involved in the present motion. If the parties can point out the court's error in failing to locate the proof of claim (e.g., it may have been filed under a different name), it will be corrected.

2. SNAPBACK PROVISION IF MOTION WITHDRAWN- The movants will be allowed to withdraw their motions to withdraw their proofs of claim by Friday, January 15, 1999. In such case, the right to a jury trial will be waived, and a trial will be held in the bankruptcy court, unless the district court rules otherwise.

3. SNAPBACK FOR SETTLEMENT PURPOSES- Also, to facilitate settlement of BRA proceedings, any portion of a claim being withdrawn may be reinstated as part of a settlement with the trustee.

4. COPY TO BE FILED IN MAIN CASE- A copy of this order will be filed in the main case.
